Frogans Technology User Policy (OP3FT)

The Frogans technology is held by the OP3FT as part of its public-interest mission. Any person intending to use the Frogans technology must comply with a policy drawn up and adopted by the OP3FT. This policy, referred to as the Frogans Technology User Policy, is published on the official Web site of the Frogans technology at the following permanent URL: https://www.frogans.org/en/resources/ftup/access.html.

The Frogans Technology User Policy concerns, amongst others, holders of Frogans addresses and Frogans networks, FCR account administrators, users of FCR WHOIS data, users of FCR public data, as well as the FCR Operator.

Uniform Dispute Resolution Policy for Frogans Addresses (OP3FT)

With a view to protecting trademark holders from abusive registrations of Frogans addresses and Frogans networks in the FCR, the OP3FT has adapted the Uniform Domain Name Dispute Resolution Policy (UDRP) and its Rules, which are in force in each registry operated under a delegation agreement with ICANN, by transposing them to Frogans addresses and Frogans networks. The resulting Policy, called the Uniform Dispute Resolution Policy for Frogans Addresses (UDRP-F), and its Rules are published on the official Web site of the Frogans technology at the following permanent URL: https://www.frogans.org/en/resources/udrpf/access.html.

OP3FT Trademark Usage Policy

The OP3FT is the holder of trademarks in relation to the Frogans technology, notably "Frogans", transcriptions of the "Frogans" trademark into different languages and writing systems, "FSDL", "FNSL", "FPUL", "OP3FT", the figurative trademark "Frogans Star" and the figurative trademark "Two superimposed yellow and blue rectangles" identifying Frogans Player. Anyone intending to use a trademark of the OP3FT must comply with a policy drawn up and adopted by the OP3FT. This policy, referred to as the OP3FT Trademark Usage Policy, is published on the official Web site of the Frogans technology (www.frogans.org) at the following permanent URL: https://www.frogans.org/en/resources/otup/access.html.

The trademarks of the OP3FT are registered or under registration process in France, other European Union countries, the United States, Canada, Australia, China, India, Japan or in other countries in Latin America, Africa and Asia.

FCR Account Administrator Agreement

Any individual or organization intending to become an FCR account administrator with a view to registering Frogans addresses and Frogans networks in the FCR, either on behalf of third parties or for itself, must enter into an agreement with the FCR Operator. This agreement, called the FCR Account Administrator Agreement, is published on the Web site of the FCR Operator at the following permanent URL: https://fcr.frogans/en/resources/fcraaa/access.html.

FCR Delegation Agreement (OP3FT)

The role of the FCR Operator is defined in the Bylaws of the OP3FT. The obligations of the FCR Operator, including the payment to the OP3FT of royalties relating to the license to operate the FCR, are set forth in a delegation agreement signed with the OP3FT. These obligations are detailed in the Frogans Technology User Policy. Terms of use of the addressing services provided by the FCR Operator (fcr.frogans subdomains)

The use of the addressing services provided by the FCR Operator is governed by the Frogans Technology User Policy. The initial version and the updates of this policy are published on the official Web site of the Frogans technology at the following permanent URL: https://www.frogans.org/en/resources/ftup/access.html.

Pending future updates of the Frogans Technology User Policy, the following conditions apply:

1. The addressing services of the FCR Operator are provided via a multi-stakeholder interface. This multi-stakeholder interface comprises an API (Application Programming Interface), called the FCR API, which is organized into sections, processes and actions. The language used for the FCR API is English. The FCR API can be used:

The addressing services provided by the FCR Operator are accessible to any individual or organization that wishes to provide registration-management services for Frogans addresses and for Frogans networks in the FCR to holders of Frogans addresses and of Frogans networks, by becoming an FCR account administrator. To fulfill their mission, FCR account administrators subscribe to the addressing services provided by the FCR Operator, under the FCR Account Administrator Agreement.

3. Whether they use the FCR API manually or automatically, FCR account administrators undertake to read and respect the instructions associated with each section, process and action, as described in the HTML interface of the FCR API. During the priority registration period for trademark holders, and then during the priority registration period for entrepreneurs, only some of the sections, processes and actions of the FCR API are available.

4. The information provided in the HTML interface of the FCR API is extracted from the FCR-MSI (FCR Multi-Stakeholder Interface) technical specification drawn up by the OP3FT. Therefore this information is subject to the terms of use which apply to the information and documents presented on the official Web site of the Frogans technology (www.frogans.org) published by the OP3FT.

5. The source code of the HTML interface of the FCR API is developed by the FCR Operator. The terms of use which apply to the source code are set forth in the "COPYRIGHT-AND-LICENSE.txt" file included in the source code. The same applies to the use of software development kits (SDKs) of the FCR API, which are provided by the FCR Operator.

6. The use of certain sections, processes or actions of the FCR API requires the collection of personal information, such as contact information and connection data, in particular for the opening of an FCR account or for the registration of a dedicated Frogans network in the FCR. The FCR Operator undertakes never to sell this personal information to third parties. The FCR Operator also undertakes never to disclose this personal information to third parties, except:

In case of contradiction between, on the one hand, a clause or a definition contained in the Frogans Technology User Policy and, on the other hand, a clause contained in these terms of use, only the Frogans Technology User Policy shall apply, and the contradictory information is not to be taken into account.
